This Public Offer (“Offer”) sets out the terms under which users may access and purchase paid services provided through MushroomID.org (“MushroomID”, “Website”, “Service”, “we”, “us”, or “our”).
By purchasing a subscription, making a payment, or otherwise using a paid feature of MushroomID.org, you confirm that you have read, understood, and accepted this Offer.
1. General Provisions
1.1. This document constitutes a public offer to enter into an agreement for the provision of digital services through MushroomID.org.
1.2. The Website provides tools related to mushroom identification, including automated analysis of photographs uploaded by users, informational materials, identification history, community features, and other functionality that may be made available from time to time.
1.3. Some features may be available free of charge, while others require payment or an active subscription.
1.4. Acceptance of this Offer occurs when the user completes a payment for a paid service or subscription.
From that moment, an agreement between the user and the Service provider is considered concluded under the terms of this Offer.
2. Description of the Service
2.1. MushroomID.org provides an automated mushroom identification service based on photographs submitted by users.
2.2. The Service may use machine-learning models, computer-vision systems, external APIs, third-party infrastructure, or other automated technologies to analyze photographs.
2.3. Identification results may include:
- suggested mushroom species;
- alternative possible species;
- informational descriptions;
- characteristics of the identified mushroom;
- warnings regarding potentially poisonous or dangerous species;
- other reference information.
2.4. The exact functionality available to a user may depend on the selected tariff, subscription, account status, location, technical capabilities of the Website, or other factors.
2.5. MushroomID.org reserves the right to add, modify, replace, or discontinue individual features provided that such changes do not materially deprive users of already purchased services without reasonable grounds.
3. Important Mushroom Identification Disclaimer
3.1. Mushroom identification performed by MushroomID.org is automated and may be incorrect.
3.2. The Service does not guarantee that any mushroom identification result is accurate, complete, or suitable for determining whether a mushroom is edible.
3.3. You must never eat, taste, cook, preserve, sell, or otherwise use a wild mushroom solely on the basis of an identification provided by MushroomID.org.
3.4. Some edible and poisonous mushrooms can look extremely similar. Identification may also be affected by photograph quality, lighting, maturity of the mushroom, missing anatomical details, regional differences, or other factors.
3.5. Before consuming any wild mushroom, users should obtain confirmation from a qualified local mycologist or another competent mushroom expert.
3.6. MushroomID.org is an informational tool and is not a substitute for professional mycological, medical, toxicological, or other expert advice.
4. Paid Services and Subscriptions
4.1. MushroomID.org may offer paid access to additional mushroom identifications, extended usage limits, premium functionality, subscriptions, or other digital services.
4.2. The available plans, prices, duration, usage limits, and included features are displayed on the Website before payment.
4.3. The price displayed at the time the user confirms the purchase applies to that transaction.
4.4. Prices may be displayed in different currencies depending on the user’s country, payment provider, or Website settings.
4.5. MushroomID.org may change prices for future purchases at any time.
A price change does not retroactively change the cost of a service that has already been paid for.
5. Subscription Period
5.1. If a paid service is offered as a subscription, access to the relevant features is provided for the subscription period specified before purchase.
5.2. Depending on the payment method and the terms displayed during purchase, subscriptions may be:
- one-time subscriptions that expire automatically at the end of the paid period; or
- automatically renewable subscriptions.
5.3. If automatic renewal applies, this will be disclosed before the user confirms payment.
5.4. For automatically renewable subscriptions, the applicable subscription fee may be charged for each subsequent billing period until the subscription is cancelled.
5.5. Users may cancel future renewal using the cancellation method available through the Website or the relevant payment provider.
Cancellation normally prevents future charges but does not automatically terminate access for a subscription period that has already been paid for.
6. Payment
6.1. Payment is made using the payment methods offered on MushroomID.org at the time of purchase.
6.2. Payments may be processed by independent third-party payment providers.
6.3. The payment provider may request information necessary to process the transaction.
MushroomID.org generally does not receive or store complete bank card numbers or card security codes when card details are entered directly on the payment provider’s interface.
6.4. The user’s payment obligation is considered fulfilled when the payment provider confirms successful payment.
6.5. The user is responsible for ensuring that the payment information provided is correct and that they are authorized to use the selected payment method.
6.6. Any fees charged by the user’s bank, card issuer, payment system, currency-conversion provider, or other financial intermediary are the responsibility of the user unless expressly stated otherwise.
7. Provision of Digital Services
7.1. Paid digital services are normally activated automatically after successful payment confirmation.
7.2. Access may be linked to:
- the user’s account;
- browser or device identifiers;
- transaction information;
- another technical identifier used by the Service.
7.3. The Service is considered provided when the user receives access to the paid functionality included in the purchased plan.
7.4. Temporary technical interruptions do not automatically constitute failure to provide the Service if they are caused by maintenance, third-party infrastructure, Internet connectivity, force majeure, security measures, or other circumstances reasonably beyond our control.
7.5. If a payment was successfully completed but paid access was not activated due to a technical error, the user should contact MushroomID.org support. We may restore access, extend the paid period where appropriate, or issue a refund.
8. Refunds
8.1. Because MushroomID.org provides digital services that may become available immediately after payment, refund eligibility may depend on whether the paid functionality has already been used and on applicable consumer-protection law.
8.2. A user may request a refund if, for example:
- payment was charged incorrectly or more than once;
- paid access was not provided due to a technical problem attributable to MushroomID.org;
- another circumstance gives the user a mandatory right to a refund under applicable law.
8.3. A refund may be refused where legally permitted if the purchased digital service has already been substantially provided or consumed.
For example, if a user purchases access to additional mushroom identifications and uses that access, the corresponding part of the service may be considered provided.
8.4. Requests for refunds should include sufficient information to identify the transaction, such as the payment date, amount, email address associated with the account, and transaction identifier where available.
8.5. Approved refunds are generally returned using the original payment method.
The time required for the refunded amount to appear depends on the payment provider and the user’s bank.
8.6. Nothing in this section limits any non-waivable consumer rights granted by applicable law.
9. User Obligations
9.1. When using MushroomID.org, the user agrees:
- not to use the Service for unlawful purposes;
- not to interfere with the operation or security of the Website;
- not to bypass usage limits or payment restrictions;
- not to use automated scripts, bots, scraping tools, or similar methods to access the Service without our permission;
- not to attempt unauthorized access to accounts, servers, APIs, databases, or other systems;
- not to submit content that violates third-party rights or applicable law.
9.2. The user must provide photographs of sufficient quality for identification where reasonably possible.
9.3. The user understands that even a high-quality photograph does not guarantee correct mushroom identification.
10. Accounts and Access
10.1. Some paid services may require an account.
10.2. Users are responsible for maintaining the security of their account credentials and for activities performed through their account.
10.3. Users must notify us if they reasonably believe that unauthorized access to their account has occurred.
10.4. MushroomID.org may temporarily restrict or suspend access where reasonably necessary to:
- prevent fraud or abuse;
- protect the Website or other users;
- investigate unauthorized activity;
- enforce this Offer;
- comply with legal requirements.
11. Intellectual Property
11.1. Unless otherwise stated, the Website, software, design, database structure, texts, interfaces, trademarks, logos, algorithms, and other elements of MushroomID.org are protected by applicable intellectual-property laws.
11.2. Paying for access to the Service does not transfer intellectual-property rights to the user.
11.3. Users receive a limited, non-exclusive, non-transferable right to use the purchased functionality for personal purposes during the applicable access period.
11.4. Users retain rights they may have in photographs and other content they upload.
The processing of uploaded content is governed additionally by the Website’s Privacy Policy and other applicable terms.
12. Availability and Modification of the Service
12.1. We aim to keep MushroomID.org available and operational but do not guarantee uninterrupted or error-free access.
12.2. The Website may occasionally be unavailable because of:
- maintenance;
- software updates;
- server failures;
- network disruptions;
- third-party service outages;
- security incidents;
- circumstances beyond our reasonable control.
12.3. We may update the software, identification algorithms, databases, interface, available species information, and other components of the Service.
12.4. Different versions of the Service may produce different identification results for the same photograph as technologies and databases are updated.
13. Limitation of Liability
13.1. To the maximum extent permitted by applicable law, MushroomID.org is not liable for decisions made solely on the basis of mushroom identification results provided by the Service.
13.2. In particular, MushroomID.org must not be used as the sole basis for determining whether a wild mushroom is safe to consume.
13.3. MushroomID.org is not responsible for poisoning, allergic reactions, illness, injury, property damage, financial loss, or other consequences resulting from the consumption, handling, sale, purchase, preparation, or use of mushrooms identified through the Service.
13.4. Users remain responsible for independently verifying identification results where safety, health, or other significant consequences are involved.
13.5. Where liability cannot legally be excluded, it shall be limited to the extent permitted by applicable law.
Nothing in this Offer excludes liability that cannot lawfully be excluded or restricted.
14. Third-Party Services
14.1. MushroomID.org may rely on third-party providers for payment processing, hosting, cloud infrastructure, artificial intelligence, analytics, communications, and other functionality.
14.2. We are not responsible for interruptions or failures caused exclusively by independent third-party services that are outside our reasonable control.
14.3. Users may also be subject to the terms and privacy policies of third-party providers where they interact directly with those services.
15. Personal Data
15.1. Personal information is processed in accordance with the MushroomID.org Privacy Policy.
15.2. By using the Website, users acknowledge that certain information must be processed in order to provide the requested services.
15.3. Photographs submitted for mushroom identification may be transferred to technical systems or service providers involved in image analysis.
16. Termination
16.1. The user may stop using MushroomID.org at any time.
16.2. Cancellation of a subscription does not normally result in reimbursement for an already used or partially used subscription period unless required by applicable law or expressly provided otherwise.
16.3. MushroomID.org may terminate or restrict a user’s access in the event of material or repeated violations of this Offer, fraud, attempts to circumvent payment, misuse of the Service, security threats, or unlawful activity.
17. Force Majeure
Neither party shall be liable for failure or delay in performing obligations caused by circumstances beyond reasonable control, including natural disasters, war, government restrictions, Internet or telecommunications failures, power outages, large-scale infrastructure failures, cyberattacks, or similar events.
18. Changes to This Offer
18.1. MushroomID.org may update this Offer from time to time.
18.2. The current version will be published on the Website with the date of the latest update.
18.3. Changes generally apply to purchases and actions occurring after the updated Offer becomes effective.
Terms applicable to an already completed purchase will not be changed retroactively where prohibited by applicable law.
19. Governing Law and Consumer Rights
19.1. This Offer is governed by the laws applicable to the Service provider, subject to mandatory consumer-protection rules that may apply in the user’s country of residence.
19.2. If the user is a consumer in the European Union, European Economic Area, United Kingdom, or another jurisdiction providing mandatory consumer protections, nothing in this Offer deprives the user of rights that cannot legally be waived by contract.
19.3. The parties should attempt to resolve disputes through communication before initiating formal proceedings.
